1. Data controller and processing roles
Energio Limited ("Energio", "we", "us" or "our") acts as data controller for information it processes for its own business purposes, including BER PRO account administration, purchases from Energio, website operation, service communications and customer support.
For BER Scheme Data collected by a registered BER Assessor in connection with a Building Energy Rating assessment, the applicable SEAI framework may place controller responsibilities on the BER Assessor and SEAI. Where BER PRO cloud services are used to store, organise or transmit that Scheme Data on behalf of the Assessor or the Assessor's organisation, Energio may act as a technology/data-processing provider for that customer, subject to the applicable contractual arrangements.
2. Services covered

Name, email address, phone number, business or trading name, business address, Eircode, access-request status, account role, account status, authorised-device information and related account records.
BER, advisory and upgrade information
Depending on the professional service, this may include property address, Eircode, MPRN, building dimensions, room and floor-plan geometry, construction information, walls, floors, roofs, windows, doors, insulation, ventilation, heating, hot-water and renewable-system information, survey notes, photographs, supporting documents, calculations, reports and other evidence used for the BER assessment. BER PRO may also process technical information used to prepare energy-efficiency advisory outputs and upgrade recommendations, including existing building performance, proposed improvement measures and related technical calculations.

Energio billing information
Information about products and services purchased directly from Energio, including subscriptions, project credits, transaction status and related records. Payment-card details are intended to be processed by the payment provider rather than stored by Energio.
Energio Workspace does not provide a customer-invoicing service for assessors or companies and does not send their customers payment requests, bank-account details, IBAN/BIC information or payment instructions.
Communications
Information in contact requests, support requests, service correspondence and appointment communications sent through Workspace.
4. Why we process information
- To review access requests, contact applicants about their request and create individual and company accounts following approval.
- To provide BER PRO, cloud synchronisation, Workspace and report services.
- To support BER assessment, energy-advisory and upgrade-recommendation workflows chosen by the customer.
- To store and deliver project records, reports and supporting evidence.
- To administer project credits and purchases made from Energio.
- To provide technical and customer support.
- To operate, maintain and improve the service.
- To meet accounting, legal, regulatory and contractual obligations.
- To communicate important service and account information.
5. Legal bases
Depending on the activity and the processing role, processing may be based on performance of a contract, legitimate interests, legal obligations, consent where required, or processing instructions received from a customer acting as controller.
6. BER Scheme Data and professional assessments
BER PRO is designed to assist registered professionals with BER survey and assessment workflows. The registered BER Assessor remains responsible for deciding what Scheme Data is required, for complying with the applicable SEAI methodology and Code of Practice, and for ensuring that information collected and submitted is appropriate and accurate.
For company accounts, authorised Company Managers may have access to projects and operational information associated with assessors in that company workspace according to the permissions configured for the account.
DEAP Autopilot browser extension
Where an authorised BER assessor chooses to connect the BER PRO DEAP Autopilot extension, Energio may provide eligible project names, property information and supported survey values to the extension to assist the assessor with entering data into DEAP4. The extension interacts with the DEAP4 page selected by the assessor. DEAP4 is an independent external service. Assessors must review all transferred information and remain responsible for the completed assessment. Autopilot does not submit BER assessments on the assessor's behalf.
7. Digital survey, photographs and LiDAR data
BER PRO may be used to record measurements manually or with compatible device sensors, including LiDAR-based room scanning. Survey records may include room geometry, opening dimensions, storey or ceiling heights and photographic evidence. Assessors should avoid collecting unnecessary personal information in photographs or supporting documents and should verify measurements where required by professional practice and the applicable BER methodology.
8. Appointment communications
If a user chooses to send an appointment confirmation through Energio Workspace, the communication is limited to scheduling and operational appointment information such as the property/job reference, booked date, approximate time and appropriate contact information. Workspace booking messages do not include the assessor's fee, VAT amount, bank details, IBAN/BIC, payment link or request for payment.
9. Hosting and international data transfers
Energio's principal production environment is hosted using OVHcloud infrastructure in the United Kingdom. Infrastructure capacity and specific hosting plans may change as the service scales. Where personal data is transferred from the European Economic Area to the United Kingdom or another jurisdiction, Energio will use the transfer mechanism required by applicable data-protection law at the time of transfer.
10. Service providers
Energio may use service providers for cloud infrastructure, object storage, payment processing, transactional email, CAPTCHA/anti-abuse services and other functions required to provide the service. Providers receive information relevant to their role subject to applicable contractual and data-protection requirements.
11. Cookies and similar technologies
Energio.ie uses technologies required to provide requested website functions and may use optional technologies only in accordance with applicable consent requirements. Users can manage optional preferences through the Cookie Settings control on Energio.ie. See the Cookie Policy.
12. Retention
BER Scheme Data processed through BER PRO may need to be retained by or on behalf of the registered BER Assessor or Principal for the period required by the applicable SEAI BER Assessor Code of Practice. Assessors remain responsible for following the then-current SEAI requirements applicable to their records.
Other account, purchase, support and website information may have different retention periods based on the purpose of processing, contractual requirements and applicable law. Account closure will not automatically require deletion of records that must lawfully or professionally be retained.
13. Data subject rights
Subject to applicable law and the relevant processing role, individuals may have rights of access, correction, deletion, restriction, objection, portability and withdrawal of consent where processing is based on consent. Identity verification may be required. Individuals may also raise concerns with the Irish Data Protection Commission or another competent supervisory authority.
14. Children
Energio and BER PRO are professional services and are not intended for use by children.
15. Changes to this policy
Energio may update this Privacy Policy as the service or legal requirements develop. The current version and effective date will be published on Energio.ie. Material changes may also be communicated through the service where appropriate.
16. Contact
Privacy and data-protection enquiries should be sent to Energio Limited at support@energio.ie.
